Copywriting?

I want to know what processes you have to take to copywright your site/images, ( eg, just have text saying its copywrited? )

also what does the copywrighting actually do ?

i dont really understand,

if someone steals my artwork and uses it on their site, what can i do,

I have read that if i create it that i automatically own the copywright to it but how do i stop them using the pece on their site,

if i put “copyright myname” is that legal will it work in court ?, also how can i prove that i created the work?

I’m tempted to refer you to the posts above from max and Fester - and leave it at that.

However, I will answer your specific questions.

  1. If someone passes off your work as their own (and gains either reputation or financial gain ie a job, freelance commission, etc) you have to contact the protaganist and advise him of your view and request he desist from further use of the work(s). You may wish to consider legal action if you have lost/he has gained remuneration

  2. There is no technology available to stop anyone stealing any of your work at any time, in the past, now or in the future. This works for anything that has been created be it a book, an image, a website, a car, a boat, a flavoured drink. If it has been created it can be ‘stolen’. Ever been to Marmaris in Turkey? The whole community earns its income from selling fake designer clothes and watches. They get away with it by admitting at point of sale that it is a fake - ie they are not passing it off as their own work.

  3. What is the work you want to protect? Remember you can’t copyright proprietary code, ie HTML. The instruction to make text bold is the same for us all. If it’s a navigation system or an image then I’d recommend the following:

a) put a small © symbol and your name on the image - that at least means they have to do some work removing it before they use it for their own ends, which may be enough for them not to bother

b) Keep all original files - every jpg created in photoshop has a corresponding psd. Every swf has a corresponding fla (or liv, etc).

c) when you complete a work, say a full website, archive two copies of all original work onto CD or zip. One for your own records and the other you send via registered post to your home address. When it arrives DO NOT OPEN IT! This is a straightforward way of authenticating your work (at a particular moment in time due to proof of delivery) should this be required in litigation.

Please note this is not a compelte investigation into the subject - it is massive, and I’ve worked for too long in the copyright field to explore every possibility here (and I’m not going to ;)). However, I hope that the above gives you some idea of how to proceed.
