I have been contemplating if i should add Mp3’s to my web site through flash. If i supply there web address and the author of the song, would this be legal? I really dont want to get into any legal situations, because i dont have that kind of money:smirk: :esmirk:

In all actuallity as long as you are not allowing people to download it… It isn’t really illegal… But still… I dunno… it’s like a radio show credential system.

Putting the name and author of copyrighted material does not grant you any privileges. You must explicitly get the thumbs up from whoever owns it. So they can still sue your pants off.
why not contact them/their record comapny and get a permession?

its legal to play mp3s on your site - it’s something that I’ve been finding out. You only have to pay royalties if you’re a major distributor of music, such as a radio station, or a site like Launch. College radio stations and small internet broadcasters don’t have to pay - this is something that the recording industry just worked out yesterday through the office of patents.
So, it’s ok for you to play as long as you’re not distributing them. If people can download mp3s from your site, that’s definitely illegal. However, if you just play them, its ok, since you’re small.
Recording companies recognize that they won’t be able to get rid of smaller internet broadcasters. As a matter of fact, small broadcasters and community supported online stations complained to the office of patents that it would drive them out of business. The recording companies decided they would only go after big broadcasters and broadcasters with revenue.
However, if you got the mp3 illegally (not actually owning the CD yourself, or buying the mp3 from an authorized dealer), then you can’t play it at all…

that’s true too. And I’ve looked into this stuff, since I’m trying to do that online radio station thing, and so far, I haven’t found anything that prevents me from doing it. However, once the site gets bigger, with more people visiting it, I’ll have to worry about that. And even then, since I don’t make revenue from the site, and I never will, I’ll only to pay a small fee.

I wouldn’t do it. mp3’s on a site without the artist’s permission,
small site or not, is going to get you a nice little Cease and Dissist
letter on pretty letterhead from a lawyer.
I have my own music from a band, published cd’s and artwork, etc
and if we ever saw someone using our stuff without explicit
permission from us, they CANNOT use it.
This is a long-standing copyright issue, from photography to
artwork to music. I wouldn’t risk it for the headache.
Lava - if you want to play artist’s music on a radio station, you
have to pay for each play of that song to the artist. ASCAP and
other music industry people will be sure to collect from you as
well.
