Well,
A client i have wants to use part of a song in his flash intro.
I tried to tell him its illegal but he insists that its ok and the every big company has nice corprate people who will let him use there music on his web-site.
So since he wont belive, does anybody know of a place where i can get some written material that says that you cant do that.
Also, if he did write to the company and ask if he can use a portion of there song (i dont know what song he is talking about, i think its just some jazz) do you think they would write back and let him?

I don’t know if they would let him… but I don’t think you should include it until you see written proof from the company saying that you can use it.

Maybe you could get lucky and try contacting the artist anyway. Its a long shot but its way better than legal action :wink:

Don’t do it and insist if he wants it added that he should pay you for what you’ve done so far and tell him to take a hike. Something like that could be as small as a slap on the hand to a big lawsuit.

actully, i am not sure yet as he still has to drop of the pics for his galleries and the music. So i’ll tell u when i get it.

actually you could just put the darn song there and when he’s told to remove it you charge the guy some more for changing it :bad: :wink:

just remember that you the designer are as liable as the client

or get your client to sign a contract which states…
all materials used are to be provided by the client, with written word of any and all copyright clearance. And that in the event that copyright clearance is required, the usage of such material is subject to having the correct documentation stating clearly that the content may be used for the purposes as declared by your client in name.

and no they won’t let hime use the track unless the band/artist/s are in REAL need of some exposure. They of course are going to want to get royalties, since the track is essentially being used as a marketing tool for the company (client)

hum, i don’t know if what i’ll say is ‘international’ (i suppose so, tho)
but many teachers told me that you can use up to 10 seconds of a song without having to pay royalty.

in the U.S I thought it was a 30 second sound clip, and 10 second video clip but I may have them mixed up, but it is something like that…:slight_smile:

I had this same problem, my solution was, dynamically load the song, that way when the client puts the song they want use in the proper folder it is they who are responsible for the file, my program simply loaded any file they placed there without discretion thus seperating me from the liability side of things…then again the ong wasnt part of an intro and didnt really have to sync up with anything…so I think I just spammed and wasted everyones time…I’ll stop now.

simple, add that song to the site, dont add your credits or host that site on your servers, remove everything like watermarks and labels which says its done by you, charge everything in cash.

or

simply do the site, get a contract signed from him saying whatever happens designer is not responsible, its purely the site owners decision and his risk, also add that designer informed the owner about the illegal aspect of this deal, get it signed and sealed, atleast you will get out of the way, if anything happens, u have a legal contract to bail you out.

This kind of a thing is legal here, i hav done it many times too…clients want their fav songs to be on their webbyz, i get the contract signed by them beforehand.

make sure its applicable there, check it with your lawyers.
